OpenAI's body problem
A model without a device is a guest in someone else's house. OpenAI bought Ive to grow a body. Apple sued to remind it whose house it had been living in.
Situation
01OpenAI spent two years as the default mind of the consumer internet, living inside Safari, inside iOS, inside Microsoft's suite. That was hospitality, not ownership. The purchase of io — Jony Ive's studio, staffed with former Apple people — was an attempt to grow a body. Apple's trade-secret suit, filed as OpenAI moved toward hardware, is the host reminding the guest that the silverware is counted. Google, meanwhile, did not sue. It leased Apple the model that will sit in Siri. The field has sorted into those who own a channel, those who rent one, and those who are trying to build a door.
Facts
02- 01OpenAI acquired io, the device company founded by Jony Ive and other ex-Apple designers, as the core of a hardware effort.
- 02Apple filed suit alleging OpenAI stole trade secrets and confidential information, coinciding with OpenAI's hardware push.
- 03Apple's own ChatGPT integration on iOS is still present, now secondary to the Gemini-based Siri path announced with Google.
- 04Microsoft remains OpenAI's principal cloud and distribution partner, a relationship the tape has started to treat as a risk factor as well as an asset.
Assessment
03We assess that OpenAI's strategic problem is no longer model quality in the abstract. It is embodiment. A chat window is a habit, not a lock-in. A device is a lock-in, which is why Apple cares and why Ive was hired. Building a device that is not a toy, against Apple, in 2026, with a legal perimeter drawn by Apple's counsel, is a ten-year project being run on a two-year clock.
The suit may settle. The information in it will not. Apple has told every supplier and every former employee that the wall is real. That, more than damages, is the point.
If you are an operator choosing a model vendor, this file is about counterparty risk: OpenAI is simultaneously a partner to Microsoft, a defendant to Apple, and a would-be hardware company. Those hats do not sit comfortably on one head.
Implications
04- Hardware is now part of the model-lab strategy set, which means capital intensity and legal surface area both go up.
- Apple will use the courts as a product strategy. Expect more of this, not less.
- Microsoft's OpenAI exposure is no longer just a capex story. It is a conflict-of-hats story.
Recommended action
05Do not pick a frontier vendor on leaderboard position alone. Write the counterparty page: who hosts you, who can sue you, who can kick you out of the default slot. Revisit that page after the Apple event and after any io hardware leak.
What to watch
06- io hardware timeline and any Apple injunction seeking to slow it.
- Whether the ChatGPT iOS integration is quietly buried after 9 September.
- Microsoft language on OpenAI exclusivity and conflict.
